The Settlement Class consists of all consumers in the United States, who, prior to October 15, 2004, purchased or acquired a Toshiba DVD player.

- Who is excluded from the class?
Excluded from membership in the Class are the following: (1) Toshiba, including employees and immediate family members; (2) retailers, wholesalers and other middlemen who purchased a Toshiba DVD Player for resale; and, (3) persons who timely and validly opt to exclude themselves from the Class.
